Kansas Bill Proposes Drug Testing In Serious Accidents
The Kansas House Judiciary Committee is considering House Bill 2617, which will mandate drug testing for both drivers and passengers involved in accidents in which someone is injured. Current Kansas law enables police officers to order a test if they have reasonable grounds to suspect drug use.
A major issue for the judiciary committee to consider is whether it is constitutional to force someone to submit to a blood or urine test if there is no probable cause to suspect them of a crime.
The Kansas Association of Chiefs of Police suppors the law, but wants amendments to make the situations where drug tests are mandatory.
